Eight Airmen receive Article 15s Published Feb. 12, 2008 36th Wing Legal Office ANDERSEN AIR FORCE BASE, Guam -- During the month of January 2008, eight Andersen Airmen received Nonjudicial Punishment. The circumstances of the cases are as follows: An arman fist cass from the 734th Air Mobility Squadron was negligent in operating a forklift which caused it to overturn in violation of Article 92, Uniform Code of Military Justice. For this action, the member received a reduction to the rank of airman and a reprimand. A senior airman from the 554th RED HORSE Squadron was drunk and disorderly in violation of Article 134, UCMJ. For this action, the member received 30 days restriction to Andersen, 30 days restriction from all facilities that serve or sell alcohol, forfeiture of $941, and a reprimand. A senior airman from the 36th Security Forces Squadron used his Government Travel Card for personal use and failed to pay his Military Star account in violation of Article 92, UCMJ. For these actions, the member received a suspended reduction to the rank of airman first class and 14 days restriction to Andersen. An airman first class from the 36th Maintenance Squadron wrongfully used marijuana in violation of Article 112a, UCMJ. For this action, the member received a reduction to the rank of airman, 45 days extra duty, and a reprimand. An airman first class from the 36th Logistics Readiness Squadron failed to properly perform his work duties and obey a lawful order in violation of Article 92, UCMJ. The member also made three false official statements in violation of Article 107, UCMJ. For these actions, the member received a reduction to the rank of airman. An airman from the 36th Medical Operations Squadron had an open container of alcohol in his vehicle and provided alcohol to a minor in violation of Article 92, UCMJ. For these actions, the member received a reduction to the rank of Airman Basic and 45 days restriction to Andersen. An airman basic from the 36th Munitions Squadron hit someone in the face with his head in violation of Article 128, UCMJ. The member was also drunk and disorderly in violation of Article 134, UCMJ. For these actions, the member received 30 days restriction to Andersen, 45 days extra duty, and a reprimand. An airman first class from the 36th Munitions Squadron failed to obey a lawful order and wrongfully took someone's property. For these actions, the member received a reduction to the rank of airman, 45 days extra duty, 30 days restriction to Andersen, and a reprimand. Punishment under Article 15 of the UCMJ is action by a service member's commander in response to suspected violations of the UCMJ. The commander determines if the service member committed the offense and, if so, imposes appropriate punishment. Accepting procedures under Article 15 is a choice of forum and not an admission of guilt. Service members always have the option to turn down Article 15 proceedings and demand to be tried by court-martial.
